(b)"actualcarrier"referstothecarriertoreceivecommission,engagedinthecarriageofgoodsorpartofthetransportofpeople,includingcommissionedtoengageinthetransportofotherpeople. (c)"shipper"means: 1.iormynameinthecommissionorthecommissionandthecarrierfortheienteredintothecontractofcarriageofgoodsbyseaofpeople; 2.ioranotherpersonentrustedtomynameoriwillbecommissionedforthegoodstothecontractwiththecarriageofgoodsbyseawererelatedtothecarrier. (d)"consignee"meansapersonentitledtodeliveryofthegoods. (e)"goods",includingliveanimalsandprovidedforbytheshipperofgoodsassembledinthecontainer,palletorsimilarapparatusshipment. articleforty-thirdcarrierortheshippermayrequestwrittenconfirmationofthecontractofcarriageofgoodsbyseatosetup.however,thevoyagecharterpartyshouldbemadeinwriting.telegram,telexandfaxwithawritteneffect. carriageofgoodsbysea44tharticleofcontractsandcontractdocumentsasbillsofladingorothertransportdocumentintermsofviolationoftheprovisionsofthischapterandinvalid.theinvalidityofsuchprovisiondoesnotaffectthecontractsandbillsofladingorothertransportdocumenttheeffectivenessofotherprovisions.theinterestsofinsuranceofthegoodstransferredtothetermsofthecarrierorsimilarterms,isinvalid. 44tharticle45tharticleofthislawshallnotaffectthecarrier'scarrierintheprovisionsofthischapterotherthantheresponsibilitiesandobligationstoincreasetheirresponsibilitiesandobligations. sectioniiofthecarrier'sresponsibility article46thofthecontainercarrieroftheresponsibilityofcargoduringtheperiodistoreceivegoodsfromtheportofloadingattheportofdischargeuntilthetimeofdeliveryofthegoods,thecarrierisinchargeofthegoodsunderthefullperiod.thecarrierofnon-containershipmentsduringtheperiodofresponsibilityisfromwhenthegoodsareloadedonboardshipuntilthetimeofdischarge,thecarrierisinchargeofthegoodsunderthefullperiod.theresponsibilityofthecarrier,thecargolossordamageoccurred,exceptasotherwiseprovidedinthissection,thecarriershouldbeliable. theprecedingparagraphshallnotaffectthecarrieronthenon-containerizedcargo,thisshipbeforeandafterloadingtheresponsibility,toreachanyagreement. bethecarrierinthe47thbeforesailingshipandsailingatthetime,careshouldbetakensothattheshipisseaworthy,andproperlyequippedwiththecrew,equipment,suppliesandequipmentofshipsandcargo,coldstoragecompartment,air-conditionedcabinandtheotherladenpremisesandsecurityforreceiving,carryingandkeepingofgoods. 48thshouldbethecarriertoproperlyandcarefullyload,move,stowage,transport,custody,careandunloadingcargo. forty-nintharticleofthecarriershall,inaccordancewiththeagreedorcustomaryrouteorgeographicalgoodsshippedtotheportofdischarge. shipsatseaorattemptstorescueorreliefoflifeandpropertycausedbydeviationorotherreasonabledeviationisnotstipulatedintheprecedingparagraphconstitutesabreachofconduct. goodscannotbe50thinthetimeexpresslyagreedinthedeliveryoftheagreedportofdischarge,andforthedelayindelivery. inadditiontothecarrierinaccordancewiththeprovisionsofthischapterthecaseofliability,sincethecarrier'sfault,resultingindelayindeliveryofgoodsduetothelossordamage,thecarriershouldbeliable. inadditiontothecarrierinaccordancewiththeprovisionsofthischapterthecaseofliability,sincethecarrier'sfault,resultingindelayindeliveryofgoodsduetotheeconomiclosssuffered,eventhoughthereisnolossordamagetocargo,thecarriershouldcontinuetobeliable. thecarrierfailedtofirstparagraphofthisarticlethetimeofdeliveryofthegoodswithintheexpirationofsixtydays,therighttocompensationforlossofgoodscanrequestthatthegoodshavebeenlost. 第五十一條responsibilityforgoodslostordamageoccurredasaresultcausedbyoneofthefollowingreasons,thecarrierliability: (a)themaster,mariner,pilotorotherservantsofthecarrierinthedrivingoftheshiporthefaultofthemanagementoftheship; (b)fire,butduetothecarrier'sfault,icausedtheexception; (c)naturaldisasters,seaorothernavigablewatersoftheriskoraccident; (d)warorarmedconflict; (e)thegovernmentorthecompetentauthoritiesoftheact,orjudicialseizureofquarantinerestrictions; (vi)strikes,workstoppagesorlabor上一页 [1] [2] [3] [4] [5] [6] [7] [8] [9] [10] ... 下一页 >>
