restrictions; (vii)attempttorescueorsalvageoflifeorproperty; (h)oftheshipper,thecargoownerortheconductoftheiragents; (i)thenaturalcharacteristicsofthegoodsorinherentdefects; (j)thepackagingofgoodsormarkthelackofnon-performing,clearly; (k)bythecarefulhandlingoftheshiphasnotyetdiscoveredthepotentialdefects; (xii)non-carrierorthecarrierasaresultoftheservants,agentscausedbythefaultofotherreasons. inaccordancewiththeprovisionsofthecarrierfromliabilityintheprecedingparagraph,inadditionto(b)theprovisionsofthereasons,shallbeartheburdenofproof. fifty-secondarticleoftransportofliveanimalsbecauseofthespecialrisksinherentintheactivitiesofmateriallossordamage,thecarrier'sliability.however,thecarriershouldhavetofulfilltheshippertoprovethetransportofliveanimalsonaspecialrequest,andthataccordingtotheactualsituationoflossordamageisduetothespecialrisksinherentinsucharesult. articlefifty-thirdcarrierinthecargodeck,itshouldbetoreachanagreementwiththeshipperorshippingpracticesinlinewith,orinlinewithrelevantlawsandadministrativeregulations. thecarrierofgoodsinaccordancewiththeprecedingparagraphshallbeloadedondeck,asaresultofsuchloadingonthespecialrisksofthegoodswerelostordamaged,liability. thecarrierforbreachoftheprovisionsofthissectionwillbethefirstcargoloadedondeck,whichsufferedthelossordamageofgoodsshouldbeliable. 54tharticleofthecargoloss,damageordelayindeliveryisduetothecarrierorthecarrier'sservant,anagentcannotwaiveliabilityandotherreasonscausedbythecommoncarriercannotonlyremovetheirliabilitythescopeofliability;however,thecarrieroftheothercausesofloss,damageordelayindeliveryshallbeartheburdenofproof. articlefifty-fifththeamountofcompensationforlossofgoods,inaccordancewiththeactualvalueofthegoods;compensationfordamagedgoods,damagedgoodsinaccordancewiththedifferencebetweenbeforeandaftertheactualvalueofthegoodsortherepaircosts. therealvalueofthegoods,inaccordancewiththevalueatthetimeofshipmentplusinsuranceandfreightonly. asstipulated,theactualvalueofthegoods,compensationshouldbelessduetolossordamageofgoodsandpaylessorpaythecost-free. 56tharticleofthecarrierforgoodsdamagedorlostthemaximumamountofcompensation,inaccordancewiththenumberofgoodsorothercargounitiscalculated,eachorothershippingunitforeachunitof666.67,orcalculatedinaccordancewiththegrossweightofgoodsperkilogramforunit2tothetwointhecompensationlimit,whicheverishigher.however,theshipperbeforeshipmentofgoodstodeclarethenatureandvalue,andsetforthinthebilloflading,theshipperorthecarrierhasaseparateagreementwiththeaboveprovisionsofthisarticle,exceptthecompensationlimit. cargocontainers,palletsorsimilarapparatusassembledforshipment,billsofladingsetforthintheshipmentofsuchequipmentisinstalledinthenumberofgoodsorothercargounit,asintheprecedingparagraphreferstothenumberofgoodsorothercargounit;notsetforthineachshipment,oranapparatusasaunit. shipmentofequipmentordonotbelongtoallthecarrierprovidedbythecarrier,theshipmentshouldberegardedasanapparatusitselforaunit. article57thcarrierdelayindeliveryofgoodsduetoeconomiclossescausedbythemaximumamountofcompensationfordelayindeliveryofgoodsbythefreightamount.cargolossordamageanddelayindeliveryoccuratthesametime,thecarrier'sliabilitylimitappliestothefirstparagraphofarticle56thofthisacttheprescribedlimit. articleonthe58thcontractofcarriageofgoodsbyseaofgoodsinvolvedinloss,damageordelayindeliveryofanyactionagainstthecarrier,regardlessofwhetherthecontractofmaritimeclaimsofeitherparty,butalsowhetherundercontractortortbroughtinaccordancewithalltheapplicationofthischapteronthecarrier'sdefensesandlimitationofliabilityprovisions. proceedingsintheprecedingparagraphisaservantoragentofthecarrier'sfiledbythecarrier'sservantoragentprovesthathisorherconductwascommissionedinthecourseofemploymentorwithinthescopeoftheapplicableprovisionsoftheprecedingparagraph. provedtobethefifty-ninth,cargoloss,damageordelayindeliveryisduetointentionalorknowingthatthecarriermayresultinlossesaslightlyorasaresult,thecarriermaynotbeinvokedinthis56thor50thsection7limitationofliabilityprovisions. proved,cargoloss,damageordelayindeliveryisduetothecarrier'sservant,anagentmayintentionallyorknowinglyandrecklesslycausedthelossoromissionasaresultofthecarrier'sservantsoragentsmaynotbeinvoked56thor57thofthisactbeamendedtolimitliabilityprovisions. 60thwillbethecarrierorpartofthecarriageofgoodsentrustedtotheactualcarri上一页 [1] [2] [3] [4] [5] [6] [7] [8] [9] [10] ... 下一页 >>
